Pinal board OKs 1 of 3 requests for fee waiver extension

The Pinal County Board of Supervisors has decided to approve a 10-year extension of the D.R. Horton and Chi Construction Copper Basin development agreement in San Tan Valley, which includes a waiver of county fees, but denied similar requests by two other developers. At a previous meeting, the board had delayed the D.R. Horton request to study whether a recent Arizona Supreme Court decision, which declared government subsidies to encourage development to be unconstitutional unless the developer offered tangible benefits of equal value in return, applied. An attorney for the county and another representing developer D.R. Horton once again debated the issue before the board on Sept. 15. Timothy Berg of Fennimore Craig Law Offices said the development agreement containing a provision to allow an extension was entered into before the January ruling in the Supreme Court case of Turken v. Gordon.
