Ownership battle for Elevation Chandler returns to court
The battle over who owns Elevation Chandler continues May 25 at the Arizona Court of Appeals in Phoenix.
Lawyers for the million-dollar bidder, investor Tom Peltier of BT Capital, will present oral arguments. Peltier contends Maricopa County Superior Court Judge Bethany Hicks erred when she dismissed his lawsuit.
Elevation Chandler is a 10.6-acre site containing a partly built hotel skeleton south of Chandler Fashion Center near Loops 101 and 202.

The property was put on the market, and offers are being fielded by Cassidy Turley BRE Commercial in Phoenix.
However, Peltier claims in court papers that he has a valid contract as the rightful owner, and he says Hicks hinted the site is worth more than $1 million with no evidence for that implication.
At a trustee sale on June 15, 2009, Peltier bid $1,000,001 to buy Elevation Chandler. However, T.D. Service Co., which conducted the sale, quickly discovered errors in the sale and errors in the notices posted before the sale. The company told Peltier the sale was void and he did not own the property.
Then, he sued.
